Tinubu Government Inaugurates 10-Member Committee to Enforce Supreme Court Ruling on Local Government Autonomy | #NwokeukwuMascot

Bola Ahmed Tinubu

President Bola Tinubu’s administration has inaugurated a 10-member inter-ministerial committee tasked with enforcing the implementation of the Supreme Court judgment on local government autonomy.

The committee, inaugurated by the Secretary to the Government of the Federation (SGF), Senator George Akume, will ensure the enforcement of the Supreme Court's July 11 judgment granting financial autonomy to local governments in Nigeria.

The committee's members include the Secretary to the Government of the Federation, who serves as the Chairman; the Minister of Finance and Coordinating Minister of the Economy; the Attorney General of the Federation and Minister of Justice; the Minister of Budget and Economic Planning; the Accountant General of the Federation; and the Governor of the Central Bank of Nigeria.

Other members are the Permanent Secretary of the Federal Ministry of Finance; the Chairman of the Revenue Mobilization Allocation and Fiscal Commission; a Representative of State Governors; and a Representative of Local Governments.

In a statement on Tuesday, the Director of Information and Public Relations at the Ministry of Information, Segun Imohiosen, stated, “The committee's primary goal is to ensure that local governments are granted full autonomy, allowing them to function effectively without interference from state governments."

“This move is in line with President Bola Ahmed Tinubu’s efforts to appropriately implement the provisions of the Constitution, which recognizes local governments as the third tier of government.”

We had reported in July that the Supreme Court had ruled that the Nigerian government must pay funds allocated to local governments directly into their accounts, managed by democratically elected officials.

In a landmark judgment delivered by Justice Emmanuel Agim, the court declared it unconstitutional for state governments to withhold and utilize allocations meant for local government areas without transferring the funds, as mandated by Section 162(3) of the Constitution.

This ruling aims to ensure that local governments receive their rightful allocations, promoting decentralization and grassroots development.

The Attorney General of the Federation and Minister of Justice, Lateef Fagbemi (SAN), had filed a suit calling for local governments' autonomy in the country.

The suit sought full autonomy for local government areas across the nation. President Tinubu’s administration recently agreed with the 36 state governors to delay the implementation of financial autonomy for the 774 local government councils until October 2024.

It was learned that this resolution was reached last Monday after the federal government and state governors agreed to a three-month moratorium on local government autonomy, over concerns related to its impact on salary payments and operational viability.
