The leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, addressed the press with a defiant message following the recusal of Justice Binta Nyako from his ongoing trial at the Federal High Court in Abuja.
Kanu, who has been in solitary confinement for four years, stated, “This is my 4th year in solitary confinement, the 5th year won’t kill me.”
Justice Binta Nyako’s decision to step down came after a heated courtroom exchange where Kanu expressed his lack of confidence in her handling of his case. The judge, who has been presiding over the terrorism charges brought against Kanu by the federal government, made the unexpected move to recuse herself during proceedings on Tuesday.
Kanu’s outburst occurred when he abruptly stood up in the middle of the hearing, instructing his lawyer, Aloy Ejimako, to remain seated as he took control of the courtroom. He vocally declared his dissatisfaction with Justice Nyako, demanding her immediate recusal.
Despite objections from the federal government’s lawyer, Adegboyega Awomolo, SAN, who argued that the trial’s continuation was in line with a Supreme Court judgment, Justice Nyako insisted on withdrawing from the case. She maintained that another judge should be assigned to ensure impartiality.
Following her decision, Justice Nyako ordered that the case file be returned to the Chief Judge of the Federal High Court, John Tsoho, for reassignment to another judge.

Kanu has since been returned to the custody of the Department of State Services (DSS), while the court awaits further directives on the reassignment of the case.
