Abuja, Nigeria — In a landmark ruling, the Supreme Court of Nigeria has declared the appointment of Local Government Transition Council Committees illegal.
The Apex Court also declared that it is unconstitutional for state governors to withhold funds allocated to local government administrations, affirming financial autonomy for local governments and reinforcing their independence from state interference.
In its lead judgement read by Justice Emmanuel Agim, the apex court said the 774 local government councils in the country should manage their funds themselves.
“The Section of the Constitution for joint allocations automatically got deleted without NASS Amendment.
“Appointment of Caretaker committees is illegal and unconstitutional, no governor has any powers to appoint any CTC.
“That State governors have constituted themselves as dangerous species to the development of democracy.” Supreme Court to Nigeria.
Justice Agim's ruling was in responds to a suit filed by the Federal Government against the 36 state governors, advocating for full autonomy for Nigeria’s 774 local governments.
