ABIA SOUTH: Appeal Court to Hear Onyeizu's Petition Against Abaribe on Thursday | #NwokeukwuMascot

The Owerri Division of the Court of Appeal has scheduled Thursday, 3rd August 2023, to hear the appeal filed by Chinedu Onyeizu of the Labour Party,Challenging the striking out of his petition by the Justice Adeyinka Adebisi-led Panel 1 of the Abia State National Assembly Elections Petitions Tribunal sitting in Umuahia.

Recall our previous reports on how Onyeizu’s petition challenging the declaration of Senator Enyinnaya Abaribe of APGA, the winner of the February 25 senatorial election for Abia South was dismissed by the tribunal court for non-compliance with paragraph 18 of the first schedule of the Electoral Act.

On June 23, at the beginning of the panel's session, Onyeizu addressed the panel, alleging bias and expressing a loss of confidence in the panel. He also requested that his petition be transferred to another panel where it would be impartially heard. However, the panel overruled his request.

In an interview with him, Onyeizu cited the fact that the Justices of the Court of Appeal handling the Presidential Election Petitions, had set the precedence by hearing all petitions on their merits and refused the employment of technicalities in deciding the petitions.

Onyeizu further said he wondered why, of all the hundreds of other election petitions across the country, it was only his petition that was struck out, which according to him, confirms his worst fears on the impartiality of the panel.
