Aba North: AAC petition DSS over abuse of court order by Abia Speaker | #NwokeukwuMascot

Comrade Ezumaibe Kelechiukwu, the Abia State Chairman of the African Action Congress (AAC), has submitted a petition to the Department of State Service (DSS) regarding the "negligence of the Speaker of Abia State House of Assembly in Swearing in Hon. Aaron Uzodike".


According to recent findings, after the Independent National Electoral Commission (INEC) declared Destiny Nwagwu of the Labour Party as the winner of the Aba North State Assembly Election, Aaron Uzodike of the People's Democratic Party (PDP) challenged the matter in the Appeal Court and emerged victorious. However, Emmanuel Emeruwa, the Speaker of Abia State House of Assembly, has failed to swear him in.


In light of this, the PDP and other opposition parties in Abia have discovered that the state government, the Speaker, and most Aba North Traditional Rulers are plotting to declare Uzodike's seat vacant and call for a fresh election.


In a letter dated Monday, April 15, 2024, addressed to the DSS, the AAC expressed concern over Emeruwa's failure to swear in Uzodike despite the court's verdict from the Court of Appeal, the highest court for House of Assembly petitions.


The AAC emphasized the importance of upholding the rule of law and respecting judicial decisions, particularly when it involves the swearing-in of elected officials. The party asserted that the Speaker's disregard for the court's decision not only undermines the integrity of the judicial system but also sets a dangerous precedent for democratic institutions.


"The actions of the Speaker in this matter are deeply concerning and have raised serious questions about the commitment to upholding the principles of justice and the rule of law within the state," stated the AAC.


The party urged the DSS to intervene promptly to ensure the court's decision is respected and Uzodike is duly sworn in, in accordance with the court's ruling.


"We implore the DSS to take immediate and decisive action to rectify this situation and uphold the sanctity of the judiciary's decisions. The integrity of our democratic processes and institutions depends on adherence to the rule of law, and it is crucial that all relevant authorities, including the DSS, fulfill their role in upholding justice."


In addition to the petition to the DSS, the AAC also sent a formal request to Emeruwa, urging him to swear in Hon. Aaron Uzodike as a member of the Abia State House of Assembly representing Aba North House Constituency. This request is based on the recent Appeal Court verdict that declared Uzodike as the rightful winner of the election in that constituency.

In the letter to Emeruwa, Comrade Ezumaibe Kelechiukwu, the State Chairman of the African Action Congress party in Abia State, emphasized the need to uphold the rule of law and ensure that the will of the people is respected by promptly facilitating the swearing-in of Hon. Aaron Uzodike Emmanuel.


The AAC stressed the importance of upholding the democratic process and allowing the voice of the people to be heard through their elected representative, which the people of Aba North have been deprived of for several months.


"I trust that you will act swiftly and in accordance with the law to ensure that justice is served and that the people of Aba North House Constituency are duly represented in the Abia State House of Assembly," stated a part of the letter to Emeruwa.
