In a significant judicial ruling, the Rivers State High Court in Port Harcourt has affirmed that Martins Amaewhule and 26 other members of the Rivers State House of Assembly remain members of the People's Democratic Party (PDP). This decision follows a previous dismissal of the lawmakers by a lower court over alleged defection to the All Progressives Congress (APC).

On Monday, Justice Okogbule Gbasam delivered the judgment, stating that the claimants failed to substantiate their claims that Amaewhule and the other lawmakers had defected to the APC.

Justice Gbasam emphasized that party membership is legally established through official party registers or membership cards. He dismissed evidence such as television coverage of alleged defection ceremonies or verbal declarations as insufficient to prove party membership changes.

The case saw the PDP joining as the fourth defendant after filing a motion to be included in the proceedings. Justice Gbasam's ruling underscored that the Rivers State government must recognize and comply with all laws passed by the Assembly, affirming that the legislators remain legitimate members of the PDP. This ruling is based on the confirmation that their names are still listed in the PDP's membership register, as stipulated by party regulations.

This verdict represents a significant legal and political development, reinforcing the procedural standards for verifying party membership and the implications for legislative legitimacy and governance in Rivers State.
