Oyo Court Rules It Lacks Jurisdiction Over INEC in PDP Convention Suit, Delists Commission from Case | #NwokeukwuMascot

The ruling comes against the backdrop of earlier controversies surrounding the convention. Recall that the organisers of the Ibadan PDP Congress had relied heavily on an earlier pronouncement of the same High Court to go ahead with the convention despite multiple suits citing irregularities and seeking to halt the exercise.
During the previous sitting, counsel to INEC, Mr. O. Adeyemi, argued that as a federal institution, the commission can only be sued before a Federal High Court. He maintained that the Oyo State High Court lacked the legal competence to hear any matter in which INEC is a party, and therefore urged the court to strike out the commission’s name from the proceedings.
Delivering his ruling, Justice Ladiran Akintola upheld the objection and delisted INEC as a defendant. He held that the commission, being a federal agency, does not fall under the jurisdiction of a State High Court.
However, the judge clarified that the court retains jurisdiction over the remaining defendants, including the PDP, a party member, Folahan Malomo, the acting national chairman, Umar Damagum, and the zonal committee chairman, Ahmadu Fintiri.
The matter was subsequently adjourned to January 26, 2026, for further hearing.
Speaking after the ruling, counsel to the claimant, Musbau Adetunmbi (SAN), stated that INEC had been properly excused from the case based on its jurisdictional objection. He added that the substantive issues against the remaining defendants remain intact.
Also responding, the PDP Oyo State legal adviser, Dapo Durosharan, noted that despite INEC’s removal from the suit, proceedings involving the other defendants will continue on the adjourned date. He added that the party’s legal team will review the development and determine the next strategic steps.
The court’s decision is expected to shape the next phase of legal battles surrounding the controversial Ibadan convention.
