The Kano Federal High Court Judgement is binding on Abia State - Barr Emperor | #NwokeukwuMascot

By Barr. Emperor Gabriel Ogbonna

I just read a article on the judgment again.

It was a judgment of the Federal High court sitting in Kano, It was not a judgment of the State High Court. It was a judgment of the Federal High court. The suit is against INEC and Labour Party.

The suit is to the effect that the Labour Party not submitting a list of their members to INEC 30 days before the primaries in compliance with the Electoral Act, that Labour Party has no candidate. That was the judgment of the Court. Hmmmm

It is bad, Very baaaad. If the Federal High Court gave that judgment, it is binding on Abia State. It is different from a State High Court. And section 77 of the Electoral Act is clear on this. I saw it.

This is not good. Even before the election, the INEC chairman said that any party that dud not comply with section 77 has no candidate. On the issue of Otti not being a party in the suit, it depends on the relief sought.

If the relief is to the effect that Labour Party not complying with the law, Otti need not be a party. The judgment is against ALL the candidates of labour party in Nigeria and not just one person.

And the bad thing about that judgment is that ALL the Labour Party candidates in Nigeria are disqualified by that judgment.

This is not good. I need to read the CTC of the judgment myself and not rely on newspaper reports. But coming from a federal High court, it is not good news at all

I thought it was a state high court. The federal High court has the jurisdiction to nullify all actions of Labour Party. This is not good
